(1) If there is a dispute as to whether a commercial land is a commercial land or not or whether it is of "A" category or "B" category as written in sub-section (2) of section 2 of the Act, the magistrate shall send the matter to the designated court for decision. .
(2) If it comes before it for a decision according to sub-rule (1), the designated court will give its decision according to the prevailing Nepalese law and rule 9.
